1. Information on the collection of personal data
(1) Below we inform you about the collection of personal data when using our website. Personal data are all data that can be related to you personally, e.g. name, address, email addresses, user behavior.
(2) The responsible party pursuant to Art. 4 para. 7 EU General Data Protection Regulation (GDPR) is branchly GmbH, Auerfeldstraße 18, 81541 Munich, hello(at)branchly.de, represented by the managing directors Sebastian Flick, Markus Linnenberg (see our legal notice).
(3) When you contact us via email or through a contact form, the data you provide (your email address and your name as well as the data you enter in the free text fields) will be stored by us to answer your questions. We delete the data arising in this context after the storage is no longer necessary or restrict processing if there are legal retention obligations.
(4) If we rely on commissioned service providers for individual functions of our offer or wish to use your data for advertising purposes, we will inform you in detail about the respective processes below. We will also name the determined criteria for the storage duration.

3. Collection of personal data when visiting our website

HubSpot is an integrated software solution with which we cover various aspects of our online marketing. These include among others:
Email marketing, social media publishing & reporting, reporting, contact management (e.g. user segmentation & CRM), landing pages, and contact forms.
Our sign-up service allows visitors to our website to learn more about our company, download content, and provide their contact information as well as additional demographic information. This information, as well as the content of our website, is stored on the servers of our software partner HubSpot. They can be used by us to contact visitors to our website and to determine which of our company's services are of interest to them. All information we collect is subject to this privacy policy. We use all collected information solely for the optimization of our marketing measures.

The legal basis for processing is your consent pursuant to Art. 6 para. 1 lit. a GDPR. If you do not want the data mentioned above to be collected and processed via HubSpot, you may refuse your consent or withdraw it at any time with effect for the future.
The personal data will be stored as long as it is necessary for the fulfillment of the processing purpose. The data will be deleted as soon as it is no longer necessary for the purpose of fulfillment. In the context of processing via HubSpot, data may be transferred to the USA. The security of transmission is secured by so-called standard contractual clauses, which ensure that the processing of personal data is subject to a level of security that corresponds to that of the GDPR. If the standard contractual clauses are insufficient to establish an adequate level of security, your consent pursuant to Art. 49 para. 1 lit. a GDPR can serve as the legal basis for the transfer to third countries.
Usercentrics
On this website, we use the services of Usercentrics. The service is operated by Usercentrics GmbH, Sendlinger Straße 7, 80331 Munich. Usercentrics is a consent management service. With the help of Usercentrics, the legally required consents are obtained. In this context, the following data is processed:

5. Note on external links
Branchly GmbH is responsible as a content provider according to § 7 para. 1 Telemedia Act for the “own content” provided on www.branchly.io for use according to general laws. This own content is to be distinguished from cross-references (“links”) to content provided by other providers. Through the cross-reference, branchly GmbH provides “foreign content” for use that is marked by the URL in the browser line being different from branchly.io. These foreign contents were checked for the first time when setting the link for whether they could trigger civil or criminal liability. However, it cannot be ruled out that the content has been changed by the respective providers afterwards. Branchly GmbH does not continuously check the content to which it refers in its offer for changes that could establish liability anew. If you believe that the linked external pages violate applicable law or contain otherwise inappropriate content, please let us know. 6. Note on the form on our website
We use the HubSpot service to provide the following online form. For this purpose, we forward your data to HubSpot, which processes the data only on our behalf. See the privacy policy regarding “HubSpot”.
Please note: If you contact us via contact forms, personal data may be transferred to service providers in third countries. These third countries do not provide an adequate level of data protection. If the data is transferred to the USA, there is a risk that your data may be processed by US authorities for control and surveillance purposes without you having possibly legal remedies. The security of transmission is regularly secured by so-called standard contractual clauses, which ensure that the processing of personal data is subject to a level of security that corresponds to that of the GDPR. If the standard contractual clauses are insufficient to establish an adequate level of security, your acknowledgment of the privacy policy in the context of the contact forms shall be deemed consent within the meaning of Art. 49 para. 1 lit. a GDPR, which justifies a data transfer to unsafe third countries.
7. Miscellaneous
It is pointed out that no secure transmission is guaranteed for data transfer over the internet (e.g., in communication via email). Sensitive data should therefore either not be transmitted at all or only transmitted over a secure connection (SSL).
