1. Information on the collection of personal data

(1) In the following, we provide information on the collection of personal data when using our website. Personal data is all data that can be related to you personally, e.g., name, address, email addresses, user behavior.

(3) When you contact us by email or via a contact form, the data provided by you (your email address and your name as well as any data entered in the free text fields) will be stored by us in order to answer your questions. We delete the data arising in this context after storage is no longer necessary, or restrict processing if statutory retention obligations apply.

(4) If we rely on contracted service providers for individual functions of our offering or wish to use your data for advertising purposes, we will inform you in detail below about the respective processes. In doing so, we will also state the established criteria for the storage period.

3. Collection of personal data when visiting our website

(1) When using the website for purely informational purposes, i.e., if you do not register or otherwise transmit information to us, we only collect the personal data that your browser transmits to our server. (4) Use of third-party tools:

HubSpot is an integrated software solution that we use to cover various aspects of our online marketing. These include, among others:

Email marketing, social media publishing & reporting, reporting, contact management (e.g., user segmentation & CRM), landing pages, and contact forms.

Our registration service allows visitors to our website to learn more about our company, download content, and provide their contact information as well as additional demographic information. This information and the content of our website are stored on servers of our software partner HubSpot. It can be used by us to contact visitors to our website and to determine which services of our company are of interest to them. All information collected by us is subject to this privacy policy. We use all collected information exclusively to optimize our marketing measures.

The legal basis for processing is your consent pursuant to Art. 6 (1) lit. a GDPR. If you do not wish the aforementioned data to be collected and processed via HubSpot, you can refuse your consent or revoke it at any time with effect for the future.

Personal data is retained for as long as necessary to fulfill the processing purpose. The data will be deleted as soon as it is no longer required to achieve the purpose. In the context of processing via HubSpot, data may be transferred to the USA. The security of the transfer is safeguarded via the EU-U.S. Data Privacy Framework (DPF), to which HubSpot is subject, as well as supplementary so-called Standard Contractual Clauses (SCCs), which ensure that the processing of personal data is subject to a security level that complies with the GDPR. If the Standard Contractual Clauses are not sufficient to establish an adequate level of security, your consent pursuant to Art. 49 (1) lit. a GDPR may serve as the legal basis for the transfer to third countries.

5. Notice regarding external links

As a content provider pursuant to Section 3 (1) of the Digital Services Act (DDG), branchly GmbH is responsible under general law for its “own content” made available for use on www.branchly.io. A distinction must be made between this own content and cross-references (“links”) to content provided by other providers. Through such cross-references, branchly GmbH makes “third-party content” available for use, which is marked accordingly in the browser address bar by a URL other than branchly.io. This third-party content was checked when the link was first created to determine whether it might trigger any civil or criminal liability. However, it cannot be ruled out that the content may be modified subsequently by the respective providers. branchly GmbH does not continuously check the content to which it refers in its offering for changes that could re-establish liability. 6. Notice regarding the form on our website

We use the service of HubSpot to provide the following online forms. For this purpose, we forward your data to HubSpot, which processes the data exclusively on our behalf. See privacy policy on “HubSpot”.

Please note: If you contact us via contact forms, personal data may be transferred to service providers in third countries. These third countries do not have an adequate level of data protection. If data is transferred to the USA, there is a risk that your data may be processed by US authorities for control and monitoring purposes without you potentially having legal remedies. The security of the transfer is regularly safeguarded via so-called Standard Contractual Clauses, which ensure that the processing of personal data is subject to a security level that complies with the GDPR. If the Standard Contractual Clauses are not sufficient to establish an adequate level of security, your acknowledgment of the privacy policy in the context of the contact forms shall be deemed consent within the meaning of Art. 49 (1) lit. a GDPR, which justifies data transfer to unsafe third countries.

7. Information on Chat and Website Search

We use the search and AI chatbot of branchly GmbH (Am Kartoffelgarten 14, 81671 Munich; hereinafter “branchly”) on our website. We have concluded a data processing agreement pursuant to Art. 28 GDPR with branchly.

• When using the chatbot, your browser connects to the servers of branchly GmbH. For technical reasons, the data described below is transmitted. The data technically required for provision (in particular IP addresses) is used exclusively temporarily and is not stored permanently; logged IP addresses are anonymized. Chat logs are stored for a limited period as described below.

  • Customer search queries,

  • IP addresses of end users (which are used only temporarily and for technical reasons to provide the service),

  • Interactions with our website (pages viewed or links clicked to contextualize the chat),

  • Browser language and device type.

• In addition, each time the chatbot is used, a session ID is generated randomly to manage the chat history and enable a conversation. The session ID is linked to the respective browser session or visit to the website. It is deleted after closing the browser tab or browser and regenerated upon a possible new visit to the website when using the chat. The session ID cannot be used to identify you or analyze your usage behavior. It also does not enable cross-browser, cross-device, or cross-session tracking.

• We store chat logs for a period of 24 months. Unless you enter personally identifiable data into the chat, we have no way of attributing chat content to you.

• The legal basis for data processing is your and our legitimate interest in using the chatbot pursuant to Art. 6 (1) lit. f GDPR, Section 25 (2) No. 2 TDDDG.

8. Miscellaneous

Please note that regarding data transmission over the Internet (e.g., when communicating by email), completely secure transmission cannot be guaranteed. Sensitive data should therefore either not be transmitted at all or only via a secure connection (SSL).
